A prenuptial agreement is a contract entered into before a couple gets married. A postnuptial agreement is a contract entered into after a couple gets married. It is executed to settle the couple’s affairs and assets in the event of a divorce or separate maintenance action. On some occasions, an individual may not be ready to file for divorce, and is still interested in going to counseling, but wants some sort of protection. In Georgia, marital assets and debts continue to accrue up to the time of the entry of a Final Judgment and Decree of Divorce. However, a postnuptial agreement can allow a couple to work on their marriage while also protecting their assets. This allows the couple to focus on the marriage, not the divorce.
